Privacy Collection Notice
This collection notice covers Bball Media Pty Ltd (ACN 677 113 030) ATF Bball Media Discretionary Trust ABN 82 969 065 823 (Bball Media) and its associates, related bodies corporate, related entities and subsidiaries (collectively, ‘we’, ‘us’, and ‘our’).
Bball Media collects personal information about you for various reasons, including in order to process your registration and personalise your experience on basketball.com.au, Bball Media’s digital platforms, register you for basketball-related events and activities, enter you into promotions and competitions, share with you marketing and promotional content from Bball Media, its related companies, sponsors and partners, and otherwise to carry out its functions and for purposes as set out in our Privacy Policy.
The information you provide will be collected by or on behalf of us and may be shared across Bball Media including its associates, related bodies corporate, related entities and subsidiaries, relevant sporting bodies including the National Basketball League Pty Ltd (NBL), NBL partners and sponsors, NBL and NBL1 clubs, WNBL and WNBL clubs, BA Limited trading as Basketball Australia (BA), each State Basketball Association, government authorities (where appropriate), the National Basketball Association (NBA) and our sponsors and partners, for the purposes set out in our Privacy Policy. The information may also be shared with other third parties to help us deliver our products and services or as required by law. If you do not provide this information, we may not be able to provide all our products and services to you. We may disclose your personal information to recipients that are located outside of Australia.
Our Privacy Policy explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in our Privacy Policy and this collection notice.
Bball Media – Privacy Policy
This Privacy Policy covers the Bball Media Pty Ltd (ACN 677 113 030) ATF Bball Media Discretionary Trust ABN 82 969 065 823 (Bball Media) and its associates, related bodies corporate, related entities and subsidiaries (collectively, ‘we’, ‘us’, and ‘our’). Bball Media is committed to protecting the privacy and personal information of its fans and members. This Privacy Policy describes the practices and processes Bball Media has in place to properly manage and safeguard that information.
PRIVACY LAWS THAT APPLY
Bball Media is required to comply with the Privacy Act 1988 (Cth) (Act) and is bound by the Australian Privacy Principles (APPs) set out in the Act. The Act and the APPs establish minimum standards for the collection, use, disclosure and handling of personal information. They apply to personal information in any form, including electronic and digital form. The APPs can be accessed at the website of the office of the Australian Information Commissioner, www.privacy.gov.au.
Bball Media is also subject to other laws relating to the protection of personal information. Bball Media’s direct marketing activities must also comply with the Do Not Call Register Act 2006 (Cth) and the Spam Act 2003 (Cth).
In this Privacy Policy, unless the context otherwise requires:
Privacy Law refers to the Act, the APPs and any legislative or other legal requirement that applies to Bball Media’s collection, use, disclosure or handling of personal information.
Personal information means information or an opinion about an identified individual or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in material form or not. Personal information includes sensitive information.
Sensitive information means personal information about an individual’s racial or ethnic origin, political opinions or memberships, religious beliefs or affiliations, philosophical beliefs, professional or trade association/union memberships, sexual preferences and practices or criminal record.
CAN YOU DEAL WITH US WITHOUT IDENTIFYING YOURSELF?
In some limited situations fans, members and other individuals may be able to deal with Bball Media anonymously or using a pseudonym. For example, if you make a general inquiry via our ‘Contact Us’ page or want to make a complaint (unless the inquiry or complaint relates to a particular account). If you do not wish to be identified, we may not be able to provide the information or assistance you require.
An account is required to access the benefits of Bball Media.
BOUNCE PASS
Bounce Pass is a registration portal for basketball.com.au and NBL. By registering, you will hold an account both with Bball Media and NBL. When you register on basketball.com.au via Bounce Pass, your details (including name, email, mobile and postcode) will be shared as follows:
- Your information will be shared with the NBL, and registered users of Bounce Bass will automatically be signed up to and begin to receive communications from the NBL and NBL’s partners in accordance with the NBL’s privacy policy found here: https://nbl.com.au/pages/privacy-policy.
- During the registration process, if you choose a team to support (at the time of registration or any time in the future), your information will be shared with the specific team (whether that be an NBL club, an NBL1 club, WNBL club, NBA club, WNBA club and/or BA, depending on the selection). By way of example, where your selected team is The Boomers or The Opals, BA will receive your information.
- Bball Media may also share your information with its partners and sponsors, including those who provide content for the website (such as the NBA, BA, our media partners etc).
WHY DO WE COLLECT PERSONAL INFORMATION?
Bball Media collects personal information about you in order to process your registration and personalise your experience on basketball.com.au and Bball Media digital platforms and to register you for basketball related information and activities. Bball Media also collects personal information to enter you into trade promotions, competitions and other offers from Bball Media, its related companies, partners or sponsors. Bball Media requires information to provide you with requested products and services, events, personalised news, video content, special offers and other information, as well as to facilitate the provisions of marketing and promotional messages that may be of interest to you (including information sent by or on behalf of our sponsors and partners) and for the purposes otherwise set out in this Privacy Policy.
Bball Media uses personal information only for the purposes for which it was provided and for directly related purposes, unless you have provided your consent for us to use it for another purpose or otherwise required by or authorised under law. We may state a more specific purpose at the point we collect your information.
If you do not provide us with the information that we request, we may not be able to provide you with our products or services.
WHAT PERSONAL INFORMATION DO WE COLLECT?
Bball Media collects a wide range of personal information, but the type and amount of information collected depends on the circumstances of collection and the nature of your dealings with us. Bball Media seeks at all times to ensure that it only collects the personal information that is necessary for the purposes of its business activities. At times, Bball Media needs to collect basic identifying and contact information for users and members when signing-up to products and services on basketball.com.au.
This will usually include:
- first name, last name, date of birth,
- postal address and email address;
- phone number and other contract details;
- geographic location (including your country, suburb and postcode);
- gender;
- details of the product or service you wish to obtain from us; and
- any preferences you tell us about or share with Bball Media.
From time to time, Bball Media may require proof of identity information, including passport number, driver licence number or other government identifiers, and credit card information only where relevant.
Bball Media collects information about purchasing patterns, consumer preferences and attitudes from prospective and current fans, users and members for marketing and promotional purposes, including to analyse markets, develop marketing strategies and to identify and develop products and services that may be of interest to its customers.
We also collect information about the way our customers use Bball Media products and services. This includes information about:
- product and service usage including how you use basketball.com.au;
- club affiliations for NBL, WNBL, NBL1, NBA, WNBA and other basketball leagues if relevant;
- responses to offers made and/or promotions run by Bball Media, its affiliates, partners or sponsors;
- payment patterns and history; and
- inquiries and complaints.
If you are under 18, you should only provide personal information to Bball Media with the consent of a parent or legal guardian.
If it is reasonably necessary in the circumstances, Bball Media may collect sensitive information such as your medical history, nationality or disability backgrounds. We will only collect sensitive information about you with your consent, unless we are otherwise allowed or required by law.
HOW DO WE COLLECT PERSONAL INFORMATION?
We may collect these types of personal information either directly from you, or from third parties.
Information may be collected when you:
- access basketball.com.au;
- register for a Bball Media account;
- register for a Bball Media newsletter;
- participate in any trade promotions, competitions, program, events or other offers with the Bball Media or its partners or sponsors;
- purchase merchandise, products or services from Bball Media or an authorised agent or licensee;
- use any third party application, product or service that is associated with Bball Media;
- provide details to Bball Media in an application, consent form, competition, survey, feedback form or incident report;
- enter personal information into, or agree to having your personal information entered into, one of Bball Media’s online systems;
- contact Bball Media via email, telephone or mail;
- engage with Bball Media via social media; and/or
- apply for employment or a volunteer position with Bball Media.
Personal information may also be collected where Bball Media is required to do so by law for example, for education, child protection, work health and safety laws, charitable collections, medical treatment or other applicable legislation.
COLLECTION FROM THIRD PARTIES
Bball Media may collect personal information regarding a child from the parent or legal guardian of that child.
In some circumstances, Bball Media collects information from other third parties including, but not limited to, media partners, betting partners, content partners, the NBL, NBL clubs, WNBL, WNBL clubs, NBL1 clubs, ticketing partners, service providers and other Bball Media sponsors and partners (including those involved in events, clinics or competitions where relevant).
Our third party service providers may also collect anonymous usage data on the terms of their privacy policies. This anonymous usage data may be used to identify your device on third party digital services where we have an arrangement in place to serve ads on those third party digital services. We may also collect anonymous usage data from third party digital services.
WHAT INFORMATION WILL WE GIVE YOU WHEN WE COLLECT PERSONAL INFORMATION?
Bball Media is required by Privacy Laws to take reasonable steps to ensure that you are made aware of certain information when it collects personal information about you. For example, when collecting information, Bball Media will:
- make sure you are aware that we have collected the information (if we collect it from a third party without your knowledge);
- identify any law that authorises or requires collection of the information;
- let you know the purposes for which we collect the information, the entities that the information is likely to be disclosed to and whether the information will be transferred outside Australia; and
- tell you how to access this Privacy Policy and complaint handling procedures.
This Privacy Policy sets out this information in general terms.
OUR USE AND DISCLOSURE OF PERSONAL INFORMATION
Bball Media, and third parties to whom we may disclose personal information in accordance with this Privacy Policy, may collect, hold and use your personal information to:
- contact and/or communicate with you;
- promote and market products and services of Bball Media, the NBL and/or our partners and sponsors (including the NBA and BA) that we consider you may be interested in;
- making our digital services easier to use by eliminating the need for you to repeatedly enter the same information, allowing you to access protected parts of our digital platforms and/or allowing you to comment on content displayed on our digital services;
- verify your identity;
- complete background checks;
- research, develop, run, administer and market competitions, programs, activities and other events relating to basketball or other sports;
- research, develop and market products, services, merchandise and special offers made available by us and third parties, licensees, suppliers and sponsors;
- conduct business process functions and other administrative functions for the operation of our digital services and/or our business;
- share with our employees, related bodies corporate, joint venture entities, partners, contractors or external service providers to fulfil any of these purposes noted in this Privacy Policy. External service providers may include (without limitation) web hosting providers, IT systems administrators, payment processors, data entry service providers, outsourcing service providers, and professional advisers;
- respond to emergency situations involving or requiring medical treatment;
- keep you informed of news and information relating to various Bball Media events, activities and opportunities via various mediums; and
- using personal information as otherwise required or permitted by any applicable law (including the Privacy Act).
Bball Media may disclose your personal information to a range of organisations which include, but are not limited to:
- Bball Media employees, agents, associates and related bodies corporate;
- NBL, NBL clubs and NBL1 clubs;
- Other basketball related entities including BA, each of the State Basketball Associations, WNBL, WNBL clubs, NBA, NBA clubs, WNBA clubs and other relevant sporting bodies;
- Bball Media and NBL partners, sponsors and other third parties where relevant to the information collected;
- specific third parties authorised by you to receive information held by us;
- certain government authorities where relevant to the information collected, including local, state or federal government entities, councils and government departments;
- companies we engage to carry out functions and activities on Bball Media behalf, including direct marketing;
- our professional advisers, including our insurers, accountants, auditors and lawyers; and/or
- in other circumstances permitted by law.
DIRECT MARKETING
Bball Media, NBL and our partners and sponsors may send you direct marketing communications and information about our services and products. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. You may opt-out of receiving marketing materials by contacting us using the details set out below or by using the opt-out facilities provided.
OTHER DISCLOSURES
In addition, we may also disclose personal information:
- with your express or implied consent;
- when required or authorised by law;
- to an enforcement body when reasonably necessary; or
- to lessen or prevent a threat to an individual or public health or safety.
IS PERSONAL INFORMATION DISCLOSED OUTSIDE AUSTRALIA?
Bball Media may disclose personal information to persons or organisations that are outside Australia. Database and web hosting services provided to Bball Media may involve personal information being transferred to IT service providers based in India, Philippines, Singapore, New Zealand, the United Kingdom, Canada and the United States of America. If data is transferred overseas, Bball Media will use all best endeavours to ensure such parties are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are suitably similar to the APPs.
HOW DO WE STORE AND PROTECT YOUR PERSONAL INFORMATION?
Bball Media recognises the importance of protecting your personal information and of ensuring that it is complete, accurate, up-to-date, secure and relevant. Bball Media will take all reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date. However, we rely on the accuracy of personal information as provided to us both directly and indirectly.
Bball Media stores information in different ways, including in electronic and hard copy form. Whilst we cannot guarantee the security of your information, we take all reasonable steps to protect your personal information (and your anonymous usage data) and to keep it secure from loss, unauthorised access, modification, disclosure, interference or other misuse. We have appropriate controls in place to limit who Bball Media can view, access and/or use your personal information and anonymous usage data. Bball Media uses include strict confidentiality requirements of our employees, volunteers, service providers, security measures for system access and security measures for our website.
Much of the information we collect from and about our users and members is added to Bball Media and NBL databases. When your information is entered into Bball Media and NBL’s membership database, the information may be combined or linked with other information held about you.
WEBSITE AND COOKIES
When you visit basketball.com.au, our systems may record certain information about their use of the site, including the web pages visited and the time and date of their visit as well as the IP address visited from. Bball Media uses this information to help analyse and improve the performance of the Bball Media website.
In addition, we may use “cookies” on the Bball Media website. Cookies are small text files that assist our website retain user preferences to improve the experience of using our website. In some cases, the cookies that we use may collect some personal information. Bball Media will treat this information in the same way as other personal information we collect. You are free to disable cookies on your internet browser to prevent this information being collected; however, you will lose the benefit of the enhanced website experience that the use of cookies may offer.
Websites linked to the Bball Media website or mobile applications are not subject to Bball Media privacy standards, policies or procedures. Bball Media does not take any responsibility for the collection, use, disclosure or security of any personal information that you provide to a third-party website, which will be governed by such third party’s privacy policies.
ACCESSING OR CORRECTING YOUR PERSONAL INFORMATION
We encourage you to regularly review and update your personal information. You can access your personal information in your Bball Media account or Bounce Pass account. Otherwise, if you would like to access the personal information that we hold about you, please let us know by making a request via the contact details set out below. We will respond to your request for access within a reasonable period. If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will correct it. You can delete your Bball Media or Bounce Pass account in the account section after logging in.
RESOLVING PRIVACY ISSUES AND COMPLAINTS
Any issues or complaints in relation to the collection, use, disclosure, quality, security of and access to your personal information may be made to Bball Media in one of the following ways:
